Lead exposure can lead to severe poisoning, as Blairish Restorations Limited, a Perthshire based company, learnt recently after being charged with the violation of Section 3 of the Health and Safety at Work etc Act 1974. The prosecution was brought against the company after two workers employed on one of its sites fell ill due to lead poisoning and had to be admitted to the hospital. The Perth Sheriff Court imposed a fine of £15,000 on the company though it later reduced it to £10,000 keeping in mind the company’s economic position and the fact that it pleaded guilty and took immediate steps to make sure that no one else was further exposed to the lead.
The court found that the company failed to recognize the existence of lead in the paint at Findynate House, Findynate Estate, Strathtay, which it was renovating and thus did not take any measures to save the workers from it. Several months of working with lead did not only hurt the workers but also their families as the lead reached their homes through them.
However, the company did not try denying its responsibilities. It instead entered a plea of guilty fast and took acted swiftly to ensure that this mistake would not be repeated. The managing director of the company was aghast at this occurrence and apologized for the mistake made by it, as council for the defence, Duncan Batchelor stated.
The HSE hopes that this case will remind the primary contractors of their obligation towards the employees.
